Is Cell Phone Driving Ban State Issue?

At Wednesday's Erie city council meeting, council voted to move forward with a city ordinance, that would ban driving and talking on your cell phone, in the city of Erie. CLICK FOR VIDEO

Council voted 6-1 in favor of a study session, that would review legislation to ban hand held cell phones while driving, in the city of Erie.
Some council members want to get the county involved, to make it a county-wide ordinance.
Joe Schember voted against it, saying a ban like this should be a state law.
We sat down with State Representative, John Evans, who's on the transportation committee, and agrees it's a state issue.
"I give city council credit for taking initiative to try to deal with a safety issue that's effecting their city. However, i do think there's constitutional concerns. Whether or not it would be enforceable in a city like Erie and other place in the state." Said Evans.

Evans says a bill is now going through the committee process, and he's hopeful that it will be before the full house for a vote, in the next couple of weeks.
